BOI Reporting Obligations Remain on Hold Despite USSC Stay

As a reminder, the FinCEN beneficial ownership information (BOI) reporting freeze remains in place despite the fact that the U.S. Supreme Court issued a stay with respect to one nationwide injunction that applied (the case was Texas Top Cop Shop, Inc. v. Garland, No. 4:24-CV-478 (E.D. Texas 12/3/24)).  Despite the stay, a second nationwide injunction from a different Texas court remains in place (the case is Samantha Smith and Robert Means v. U.S. Department of the Treasury, No. 6:24-CV-336 (E.D. Texas 1/7/2025)).  The second case is based on a different set of facts and arguments and the Department of Justice has yet to file an appeal.  Reporting companies are not required to report while the injunction remains in effect, but they can voluntarily choose to submit their BOI reports.  For more information on the FinCEN BOI reporting obligations, visit Tax Facts Online.
