LPL Hit With Discrimination Lawsuit

LPL Financial is facing a lawsuit from a former employee who says she was denied a promotion for being Black.

Michelle Mann of York County, South Carolina, also was disabled due to a stress-related issue caused by her employment at LPL and was subjected to "disparate treatment and treated more harshly than other non-disabled employees." according to the suit.

According to the suit, Mann was hired by LPL as a full-time employee on or about Oct. 5, 2020, and was most recently serving as a Technical Analyst II at LPL's campus in Fort Mill, South Carolina.

Mann worked in the Customer Care Center (C3), which is a group housed in LPL's Technology Business Unit, which resolves technical issues and IT-related concerns for LPL employees, according to the suit.

Mann originally reported to Shakela "Kee-Kee" Featherson, and Featherson reported to Daniel Kummer, who is white, the suit states.

Featherson, according to the suit, "made comments to Ms. Mann that she would never hire another female employee," and also encouraged Mann "to apply for positions outside of the department such that Ms. Mann would no longer be under her supervision."

Mann reported Featherson's discriminatory comments to LPL, according to the suit.

Following the reporting activity, Mann "received worsened treatment from Featherson," the suit states. "For example, Featherson became increasingly angry and short-tempered with Ms. Mann, Featherson would avoid Ms. Mann, and Featherson created a hostile work environment for Ms. Mann."

Also, according to the suit, in or around June 2021, Mann "was denied a promotion to another department and told this was because she had not served in her current role for a year."

However, "a white male coworker who had not been employed in his role for a year was granted a similar promotion," according to the suit.

LPL "took adverse action" against Mann, according to the suit, including: "denying her a promotion in June 2021, giving her an off track mid-year performance review, denying her the AV Tech position, and constructively discharging her from employment due to the ongoing harassment, hostile work environment and discriminatory treatment."

LPL's "alleged reasons for such conduct, including her denial of the positions and 'Off Track' rating, are false and pretext for discrimination," the suit contends.

LPL did not respond to a request for comment.
