In this episode of Human Capital, we talk with George Michael Gerstein, co-chair of the Fiduciary Governance Group at Stradley Ronon in Washington, to get the latest on where the states' fiduciary rules stand.
Much debate has ensued on the legality of the states' rules, which state securities regulators have lobbed in opposition to the Securities and Exchange Commission's Regulation Best Interest – a rule they argue fails to adequately protect investors from conflicted advice.
Gerstein's take: expect Massachusetts's rule to be finalized first and that more states will jump into the fiduciary rule fray.
Listen in as Gerstein also explains the likely legal challenges the rules will face as well as the compliance risks around Environmental, Social and Governance, or ESG, investing and why some enforcement actions may be on tap.
