Lamb Organizes Suit Against Pharmacy Benefit Managers

NU Online News Service, Oct. 3, 2003, 3:43 p.m. EST – Archie Lamb, a Birmingham, Ala., lawyer, is trying to organize a class action suit by independent pharmacists against four big pharmacy benefit managers.

Lamb has filed a suit on behalf of the pharmacists in the U.S. District Court for the Northern District of Alabama.

The suit accuses the big pharmacy benefit managers of working together to lower payments to community pharmacies, according to Lamb's firm.

The lead plaintiffs are North Jackson Pharmacy Inc., Stevenson, Ala., and Big C Discount Drugs, Mobile, Ala. The suit seeks permission for the plaintiffs to represent a class that would include all independent U.S. pharmacies.

The defendants include Medco Health Solutions Inc., Franklin Lakes, N.J.; Express Scripts Inc., St. Louis; Caremark Inc., Nashville, Tenn.; and AdvancePCS Inc., Irving, Texas.

Lamb is a co-lead counsel for the physicians in the litigation against big managed care companies that is now consolidated at the U.S. District Court in Miami.
